Please read and sign and then accept the terms and conditions of the service policy agreement below before proceeding to the service repair log in
1. This agreement is between the signer and The Music Repair Depot LLC, herein referred to as The Music Repair Depot LLC and is enforced by all laws pertaining to the laws of Indiana and the Digital Millennium Copyright Act. All units brought to The Music Repair Depot LLC for repair that contain any type of electronic data are subject to this agreement. You are referred to herein as the “customer”. You may or may not be aware of such regulations.
2. We will guaranty only that the parts purchased and installed by us and labor performed by us will perform satisfactorily under the conditions of normal usage or otherwise specified on service work order for a period of time specified on the service work order. Except as expressly provided above, there is no warranty or guaranty of merchantability, or fitness for a particular purpose, or of any other kind, express or implied, with respect to the services performed or parts furnished by us, and we do not, of course, make any guaranty with the respect to any other parts. If repairs later become necessary due to other defective parts, they will be charged separately.
3. If The Music Repair Depot LLC encounters unanticipated problem, which would alter the estimate by more than 10%, The Music Repair Depot LLC shall promptly notify customer for additional authorization to proceed with services at a change in price. If customer does not authorize additional work or a change in cost, The Music Repair Depot LLC will cease work and customer will be obligated for parts and labor performed to date by The Music Repair Depot LLC.
4. The Music Repair Depot LLC shall be entitled to all liens provided by law to insure prompt payment of charges by customer, including a possessionary lien when practical. The Music Repair Depot LLC warrants that all of its work will be done professionally and in a workmanship like manner. The Music Repair Depot LLC warrants its specified work for a period of ninety (90) days. This warranty is expressly limited to replacement of parts and the provision of labor to correct the problem caused by The Music Repair Depot LLC or in the case of reoccurrence within ninety (90) days of the problem for which The Music Repair Depot LLC is contracted to remedy. This warranty provided by The Music Repair Depot LLC is in addition to and separate from any warranties provided by the manufacture of parts.
5. The Music Repair Depot LLC reserves the right to charge minimum fees for repairs not completed for any reason even if units are under manufacturer’s warranty, unless manufacturer or dealer specifies otherwise. We also reserve the right to charge administrative fees associated with time delegated to the verification of warranty status, or situations which warrant individualized attention to a particular repair or communication with the dealer or vendor, including communications to procure any necessary additional components, power supplies etc. not provided by the customer at the time of bringing in the unit for repair. All sales are final. No refunds or returns. This includes repairs, field service calls, and appraisals even if not completed for any reason.
6. Any late or non-payment by customer shall incur a penalty of $25.00 plus interest at the rate 18% Annum. (calculated at 1.5% per month), if customer were in breach of this agreement, customer shall be responsible for all reasonable attorney fees and court costs incurred by The Music Repair Depot LLC to enforce the terms of this agreement.
7. Any units that are not picked up or shipped after fifteen business (15) days upon repair completion are subject to a $10.00 per day storage fee.
8. Any units that are not picked up or shipped after ninety (90) days become property of The Music Repair Depot LLC
9. Any instruments repaired that reveal abuse (i.e. unit has been dropped, lightning damage, power surge, fire, smoke, water, beverage spill or rodent damage) will not be given a guaranty or warranty of any kind regardless of parts replaced or labor performed.
10. All units repaired by The Music Repair Depot LLC are provided with a destructive type warranty void if removed security decal. This decal is positioned in such a manner that decal will be destroyed if case, cabinet, or covers are removed to service the inside of these units. Absolutely no guaranty or warranty will be provided for previous work performed if decal is missing, destroyed, mutilated, defaced or otherwise compromised in anyway.
11. The Music Repair Depot LLC makes absolutely no claims as to exact time of length of repair due to situations and limitations beyond the control of The Music Repair Depot LLC (i.e. backordered parts, defective replacement parts, unavailable parts, shipping delays, all acts of god). The Music Repair Depot LLC does its very best to provide the level of service stated to the customer. Customer may be charged additional charges for immediate services and all or part of associated fees and services may not be performed within the time frame stated to the customer. It is the sole discretion of The Music Repair Depot LLC to make or not make adjustment for charges for such services.
12. The Music Repair Depot LLC reserves the right to refuse service to any product or anyone for any reason and is not necessarily specified with any specific reason. It is the sole discretion of The Music Repair Depot LLC if to provide detailed and specific and information to any parties involved, except that of which is provided by law. All units without or have illegible serial numbers may be refused without proof of purchase.
13. The Music Repair Depot LLC inspects all units received for repair for damage, including any scratches and imperfections; anything substantial is noted on work order. It is assumed here by signing this agreement that you are aware of any existing damages, scratches and imperfections, and you waive your right to hold The Music Repair Depot LLC responsible for any damages, scratches or imperfection prior to receiving. It is the responsibility of the customer to inform The Music Repair Depot LLC that unit to be repaired should have damages, scratches or imperfections listed on work order or separate form. A photograph or video can be provided upon request.
14. All units contracted by The Music Repair Depot LLC for repair are due payable by consignee or unless otherwise specified. All insurance claims pending are the responsibility of the owner of the unit and insurance company as payee must be approved by insurance company. Arrangements must be made in advance before work is performed as to who or whom is the responsible payee. All warranty and ext-warranty repairs denied claim are the sole responsibility of the the customer and responsible for all charges where applicable.
15. The Music Repair Depot LLC will provide upon request a written estimate on all repairs over $150.00. A 50% down payment will be required on all repairs over $250.00 before work is performed. It is at the sole discretion of The Music Repair Depot LLC to require any or none of a down payment in advance. Some repairs require 100% advance payment.
16. The Music Repair Depot LLC may be contracted by a dealer, manufacture or extended warranty provider to perform work or services to your instrument. You may or may not have information about the specific repair of your instrument. It is not the responsibility of The Music Repair Depot LLC as to provide communication between the customer and the dealer, manufacture or extended warranty provider. The Music Repair Depot LLC will not become an intermediate, for arbitration or be involved in litigation, except where provided by law.
17. All non-warranty repairs will be charged 6% of the total hourly rate for shop supplies (4 hrs. max.); this fee will cover the increasing cost of chemicals, supplies, and the increased cost of purchasing new equipment to work on new music technologies. This fee will not be added to non-repaired, estimates only (i.e. items only charged a bench fee or evaluation fee).
18. All non-warranty repairs that need parts to be repaired will have a $25.00 minimum on any parts that are not in stock (i.e. parts have to be ordered). This does not include most fuses, batteries, bulbs, general hardware, etc. However, we stock the most common fuses, batteries, bulbs, etc and it is at our discretion if to charge the $25.00 minimum on some repairs as some fuses, batteries, bulbs etc. are proprietary and must be ordered.
19. All non-warranty repairs that require parts to be ordered will be charged a $10.00 flat fee for ordering and handling of non-stocking parts, in addition some parts ordered require the defective part be returned (i.e. most PCB’s, amplifier PCB’s, some speakers, etc.). These repair’s will be charged an additional $10.00 for a total of $20.00 per repair. If unit has multiple parts required for the repair the fees are charged only once per repair.
20. All recording devices (i.e. any device you can save data and that have removable or non-removable media), keyboards, sound modules, drum machines, programmable guitar amps and pedals, digital mixers, effects processors, hard disk recorders, DAT machines, ADAT, cassette, digital workstations, computers or any device that uses any kind of data storage medium (i.e. built-in RAM, VRAM, non-VRAM, floppy disk, ZIP disk, JAZ disk, CDR, CD-RW, DVD +/- RW media, hard disk, analog tape, memory tape, flash, compact flash, memory stick, USB digital cards, removable and non-removable media memory devices are subject to this agreement. Some units require a re-initialization or hard reset during the repair or a component or board may have to be replaced that contains the chips that store the data, this data must be backed up before repair can commence if the customer wants their data saved, there will be a separate charge for this. All to common is that some units are considered broken or defective when actually the media is defective or the data is corrupted and the unit won’t function correctly. Manufactures warranty does not cover this, the customer is responsible for all charges related to data or media issues and it’s integrity, recovery and transferring. Unless there is a hardware problem some manufactures will cover the cost of non-removable drives and permanently installed memory, (i.e. SDRAM, SIMM’s etc.) but not for the data recovery or saving, transferring of such data. Some units won’t function with particular brands of media, if we determine that the media used in a unit is not recommend or has not been tested or qualified, customer will be responsible for all charges.
21. All units that require a proprietary power supply (i.e. “wall wart” or special cord with a “box” in the middle of it) will be required to supply it at the time it is logged into the shop. Do not supply (IEC cables or consumer 2 pin cords unless there is a problem with the unit turning on or is intermittent. If The Music Repair Depot LLC determine or suspect customer’s power cord is bad, and they didn’t supply it, customer will be charged a bench fee and unit will be returned. All units without an adapter will not be accepted, if unit is sent into the shop and an adapter is not supplied, customer will be contacted to send it in. Customer will be charged and administrative fee of $20.00 or the unit will be rejected and charged a bench fee and returned to customer. The Music Repair Depot LLC will not accept items to be sent in or brought in after the unit is logged in. Manufactures are increasing the amount of external adapters they use as it is less expensive, generates less heat and less interference and is cheaper to build than installing an internal supply. There is an increasing problem with customers using the wrong adapter on units or the adapter allows the unit to power up, but doesn’t supply enough power to run the unit, especially units with internal speakers and amplifier or large LCD displays. Some units can be permanently destroyed or damaged from improper adapters. Units supplied with wrong adapters or “universal adapters” will be denied warranty of any kind. Manufactures now do their very best to manufacture power adapters with different voltages and polarities to have very different ends on them to deter this problem.
22. Any units supplied to be repaired that contain copyrighted (Digital Millennium Copyright Act) pornographic, prejudice, foul language, racial, cult, gang related, or any other material deemed inappropriate to The Music Repair Depot LLC used for any reason including jingles, phone-on-hold or commercial on any media will be refused for repair, and will be charged a bench fee. No exceptions! Please backup your data and erase your media before bringing unit in for repair.
23. Any unit brought to The Music Repair Depot LLC that contains a device that can store electronic data such as all recording devices (i.e. any device you can save data and that have removable or non-removable media). Keyboards, sound modules, drum machines, programmable guitar amps and pedals, digital mixers, effects processors, hard disk recorders, DAT machines, ADAT, cassette, digital workstations, computers or any device that uses any kind of data storage medium (i.e. built-in ram, VRAM, non-VRAM, floppy disk, zip disk, JAZ disk, CDR, CD-RW, DVD +/- RW media, hard disk, analog tape, memory tape, flash, compact flash, memory stick, USB digital cards). Removable and non-removable media memory devices are subject to this agreement.
24. If you agreed to not have your data saved, you waive The Music Repair Depot LLC responsible for saving any data on any device pertaining to settings, programs, parameters, sessions, songs, sound bytes, MP3’s or any file created by you that modified a device from original state, at the time it was manufactured.
25. If you agreed to have your data saved you will be charged a minimum of $50.00, which must be paid up front, with your bench fee. This charge is non-refundable and does not guarantee that your data will be saved, recovered, or useable, as we will not guarantee the integrity of the data. Also, you will be charged for the media we use to save the data (i.e. CD, floppy disk, zip disk, flash, etc.). It is at our discretion which media that we will use. We will not guarantee that we will use media that can be directly restored to your device as some units require device be removed and installed into a computer and then have to be backed up to another device in a computer and burned to CD. It is your responsibility to be able to reinstall your saved data back into your own equipment. You will be charged at the hourly shop rate. Minimum charged for data restoration is $50.00, which must be paid up front with your bench fee. The Music Repair Depot LLC makes absolutely no claim to be successful in the restoration, as issues of data integrity, check sum, viruses, hardware changes, key codes, serial numbers, dongles, CPU id, etc, can be a factor. Some data requires installation of software from the original CD from a particular manufacture. The Music Repair Depot LLC will not under any circumstances install any software which it cannot prove to its origin, or install any software in which The Music Repair Depot LLC believes is a illegal copy. It is the customer’s responsibility to provide The Music Repair Depot LLC with all software whether on CD, disk, card or any other media. If unit to be repaired requires software supplied from the manufacture of the unit to be repaired, and that software was provided with the unit when new, The Music Repair Depot LLC will attempt to retrieve the software from the customer or manufacture. Customer will be charged administrative time at the hourly shop rate for such retrieval. It is the responsibility of the customer to provide all software, disks, cables, and manuals to return the unit to original specifications.
26. Units that have devices such as hard disk drives that may be covered under the manufactures warranty, that the customer requests that the data be recovered, and The Music Repair Depot LLC has determined that data could not be recovered by us, but could possibly be recovered by a third party data recovery service, customer may elect to have the data recovered themselves, or prefer The Music Repair Depot LLC not proceed with the data recovery at customers request for any reason. At that point the customer may take the device (i.e. hard disk drive) and leave the unit in the shop. We will not at that point order replacement media devices until customer returns original part. Such situations have to be approved by The Music Repair Depot LLC and manufacture of the product. If not, unit or device would not at that point be covered under warranty and customer would be responsible for all charges including any administrative time involved with the reassembly of the unit.
27. Any device that customer requests The Music Repair Depot LLC to save and transfer that is deemed inappropriate (i.e. copyrighted, pornographic, contains foul language, racial, gang related, terrorist related, etc.) will not be saved or transferred. Instead, entire unit will be returned and all charges will apply. At the discretion of The Music Repair Depot LLC some material deemed illegal to possess may be turned over to authorities, at which point The Music Repair Depot LLC would have no control over.
28. The Music Repair Depot LLC reserves the right to amend or change this agreement at any time without notice to any parties or for any reason, and may change while a customers unit is currently in the shop for repair. The Music Repair Depot LLC is not responsible for mistakes in typographical errors, misinformation, illegibility or misinterpretation.
